15 Laws every Indian should know about

There have been many rights and laws that people aren’t aware of yet. And many policemen have taken advantage of the ignorance and have used it against people. Here are some laws every Indian should know about:

  1. Under the Indian Sarais Act of 1867, any person can ask for water, free of charge might I add, from any hotel at any given time for them and their pets. The individual can also use the washroom for free and no one should stop them.

  2. The Criminal Code of Procedure, Section 51 states that only women officers can search and arrest women who have offended, under strict decency and privacy between 6 am and 6 pm. 

  3. According to Section 497 of the IPC, a woman cannot be charged with committing adultery. The section also mentions that she cannot even be charged for being an instigator of an adulterous relationship.

  4. As per the Section 14 of the Hindu Marriage Act 1955, a couple can only register for divorce within a year of marriage if they are experiencing major, immense problems in the relationship. Other than that, the couple can’t file for a divorce.

  5. According to a Supreme Court ruling, no woman can be arrested before sunrise and after sunset, if the police don’t have a written document stating why they want to arrest the woman.

  6. Under Article 39A of the Indian penal code, a man, and a woman should be granted equal pay at their workplaces for an equal job.

  7. The ministry of Women and Children has ruled out against letting a single man adopt a girl child in order to keep the child safe and the adoption cleaner and safer.

  8. As per the Hindu Adoption and Maintenance act of 1956, married couples can’t adopt two children of the same gender.

  9. Articles 22(1) and 22(2), of the Preventive Detention in India, states that no person arrested can be detained for more than 24 hours. They have to be produced before a judge within those twenty-four hours.

  10. The Legal Services Authorities Act of 1987 states that all female rape victims have the right to legal aid, completely free of cost. It is mandatory for the station house officer to inform the city’s legal services authority to provide a lawyer.

  11. The police cannot use the confession you provided them with against you in the court. 

  12. Under section 23 of the Bills of Rights act, every person is entitled to know the exact reason why they are being questioned or arrested and the validity of a warrant can be questioned as whether or not it is legit.

  13. If a policeman suspects a person of drinking while driving, under section 185 of Motor Vehicles Act, he can arrest the person without a warrant if they refuse to take the breathalyzer test.

  14. In a court of law, you cannot plead as a defense that you weren’t aware of the fact that the law existed. Not knowing about a law does not mean you have the right to break it.

  15. According to section 228A IPC, victims of sexual assault have the right to remain anonymous. Neither media nor police can force the victims to reveal their identity in public.
